Every signer needs a government-issued photo ID that is current or was issued within the last five years, with a physical description, signature, and serial number. The most common are a California driver's license or ID card, a U.S. passport, a U.S. military ID, or another state's driver's license. If you have no acceptable ID, California allows identification by credible witnesses under oath.

IDs a California notary can accept
- California driver's license or California ID card (DMV)
- U.S. passport or U.S. passport card
- Driver's license or ID card issued by another U.S. state
- U.S. military ID
- Passport issued by a foreign government
- Driver's license issued by Canada or Mexico
- Inmate ID, for a signer in custody at a detention facility
The ID must be current or issued within the past five years (California Civil Code §1185). Photocopies and photos of an ID on a phone can't be accepted. Not sure about your ID? Call us before the appointment at (858) 859-1779.
No ID? Use credible witnesses
California lets a notary identify a signer through credible witnesses who swear under oath to the signer's identity. You need either one credible witness who personally knows both you and the notary, or two credible witnesses who know you and who each have acceptable ID. Witnesses can't have a financial interest in the document.
Why the notary may ask for your thumbprint
California law requires a signer's right thumbprint in the notary journal for deeds affecting real property (like grant deeds and quitclaim deeds) and for powers of attorney. This protects you against real estate fraud.
Name must match
The name on your document should match your ID. A notary can usually notarize a shorter version of the name on your ID (for example "John Smith" when the ID says "John Michael Smith") but not a name that isn't on the ID.
Frequently asked questions
Can I use an expired driver's license at a notary in California?
Yes, if it was issued within the last five years. An ID that is both expired and more than five years old cannot be accepted.
Can I use a temporary paper DMV license?
Usually not by itself, because temporary paper licenses typically lack a photo. Bring your old license (if issued within five years) or another acceptable ID.
Can a notary accept a Matricula Consular or other consular ID?
Some consular IDs may qualify depending on how they are issued. Call us with the details before your appointment and we will confirm.
Does each signer need their own ID?
Yes. Every person whose signature is notarized must be identified with acceptable ID or through credible witnesses.
